“Rules are for Thee, Not for Me”

[Word on the streets is, the news media is pouring in with 91-A requests on dissemination policy and laws for SPOTS and “triple I” criminal history records!! You know what that means!? Your voices are being heard. Loud and clear. Keep it up Robbileaks faithful. We’re just getting started…]

On June 23, 2022, the New Hampshire Attorney General's Office announced the indictment of Ossipee Sergeant Justin Swift for illegally running privileged motor vehicle and/or criminal records. In an interview with WMUR TV, Assistant Attorney General Dan Jimenez said the queries by the Ossipee Sergeant "were of a personal benefit to himself, and not related to his work as a police officer." The indictment alleged Sgt. Swift ran the records on July 9, 2020. The indictment included both misdemeanor and felony charges. If convicted of the felony, Sgt. Swift would have faced 3.5 - 7 years in prison. Obviously, this is a serious matter and such actions by public officials should not be tolerated.

Ironically enough, at the exact same time certain members of the AG's office were drafting this indictment in one room, in another room they were trying to figure out how they could clear Commissioner of Safety Bob Quinn of the exact same charge. (The AG's Office is extremely adept at selective prosecution.)

On Friday, October 1, 2021, a civilian clerk within the New Hampshire State Police, Permits and Licensing Unit was approached by Trooper Michael Artega. Trooper Artega had apparently received a phone call from Commissioner Quinn, who was looking to have a criminal history run on a subject. The Commissioner knew the individual personally. He was inquiring about the subject's criminal history because this acquaintance (who resides in Massachusetts) had been denied a Massachusetts license to carry a firearm. The acquaintance did not reside in New Hampshire, had not applied for any sort of license or permit in New Hampshire that would require a criminal history. The acquaintance was not the subject of any investigation in New Hampshire which might also necessitate a criminal query. This information was simply to satisfy Commissioner Quinn's personal curiosity. One might say it was "of a personal benefit to himself, and not related to his work." (Where have I heard that before????)

Elias Furey (the clerk who was asked by Trooper Artega to run the criminal history) knew it was likely illegal. Given the directive came from the Commissioner, he completed the query, but he wisely alerted his civilian supervisor, Tiffany Foss. Furey sent Foss an email immediately upon completing the query. In the email, he stated that he knew he wasn't "supposed to run people without proper cause," but felt this was more of an order and less of a request.

On Monday, October 4, 2021, Supervisor Foss received the email from Furey. She forwarded the email to the attention of the head of Permits and Licensing, State Police Lieutenant Victor Muzzey. In her email, Supervisor Foss correctly categorized Commissioner Quinn's query request as "HIGHLY" illegal.

Two minutes after Foss sent her email to Lt. Muzzey, he replied: "Okay, thank you. I am up at Troop F today to hopefully find a part-time fingerprint clerk for up here." It would appear Lt. Muzzey was not particularly concerned about the potentially illegal nature of this query. One can only wonder why...

Surprisingly, Supervisor Foss, who had been employed by the Division of State Police for 20 years, left the Division less than three weeks later. Shortly thereafter she was contacted by an investigator from the AG's Office, who requested her to come in for an interview. Supervisor Foss had not tipped off the Ag's Office, but she cooperated fully with the investigation.

The AG did indeed launch an investigation (Funny, I don't recall seeing a press release or a media frenzy.) The AG requested Trooper Artega sit for an interview. He declined. Lt. Muzzey also did not sit for an interview. It is unclear if Major John Morasco was interviewed, but Commissioner Quinn and Colonel Nate Noyes were. So, what happened?

The Ag's Office determined they could not proceed with charges on Quinn, citing lack of cooperation from sworn personnel.

Trooper Mike Artega was promoted to Sergeant, for a position which did not exist, and he was not on a promotional list, nor had he taken a promotional exam.

Lt. Vic Muzzey was promoted to Captain.

Major John Morasco retired and was then appointed as the Director of Motor Vehicles and is now able to legally "Double Dip."

(The Commissioner wants to thank them for their silence.......Uh, I mean service.)

And Supervisor Foss, who reported this crime, was pushed out of her position. She now works at another agency.

The three sworn individuals who covered for Commissioner Quinn were rewarded with promotions. The FEMALE civilian supervisor who showed integrity was summarily drummed out of her office. And now, the AG's Office is running interference by refusing to charge a high-ranking state government official for the very same thing they bragged about when it involved charging a small-town cop. Commissioner Bob Quinn is essentially New Hampshire's very own Hunter Biden: A high profile figure who can violate the law with impunity because of his office and political connections.

Maybe the laws of New Hampshire apply only in Ossipee, and not in Concord. Given the recent protests and riots nationwide, maybe Concord became one of those "autonomous zones" where laws are not enforced. Perhaps Assistant AG Jimenez could enlighten us. His explanation would almost certainly be dazzling.

As a side note, the criminal history of the subject queried includes crimes like, Fraud, Possession of Stolen Property, Malicious Destruction of Property, Negligent Operation of a Motor Vehicle, Operating After Suspension, Leaving the Scene of an Accident w/ Property Damage, and multiple Drug Charges. One must wonder about Commissioner Quinn's judgment when his social circle includes felons.

Because the FBI maintains the database that was queried, unauthorized queries are a violation of federal as well as state law. Maybe they'd be interested. Who Knows?

The Union Leader is the only organization that reached out to Tiffany Foss, who agreed to be interviewed with her attorney present. As a good reporter should do, Mark Hayward checked sources and called many people for comment. He got a lot of "no comment" responses, but then the AG did something that even a blind man could see coming.........The charges on Sgt. Justin Swift were dropped. Gee, I wonder why? The only thing that remains to be seen is if Commissioner Quinn will now be treated the same way.....De-certified and put on the EES and of course be removed from office.
